Question:
There may remain in a person's mouth small pieces of the miswak, and he spits them out in front of him. Is he forbidden from doing so?

Answer:
Allah knows best... It is better, absolutely, to do so on his left side. However, the hadiths came regarding prayer. But if he places it on his left side, because some narrations are general, if he places it on his left side, it is good, if Allah wills, and more cautious.
Q: The commentator mentioned from Ibn Khuzaymah that whoever spits toward the qiblah will come on the Day of Resurrection with his spittle between his eyes. Is this in prayer?
The Shaykh: This is possible, and this supports that it is good to spit on his left side. As for in prayer, it is specified as the Prophet (peace and blessings be upon him) said:
So let him not spitفلا يبصقن
It is a prohibition, and the original ruling is prohibition, so he must never spit in front of him in prayer, not in voluntary prayer, nor in obligatory prayer, not in the mosque, nor elsewhere.
As for outside of prayer, this is a matter of consideration, and the matter is easy in it. But if it is on his left side, even outside of prayer, it is more complete and more cautious.
