If a man comes to us asking about the divorce of his wife, do we ask him whether he divorced her during menstruation or during purity, or are we not required to ask him?

Machine translationRead the Arabic original
The questioner : May Allah reward you. The one who comes asking about divorce, we do not ask him. Or did he divorce her during menstruation?

The Shaykh : No, it is not our concern. We are not required to ask him.

The questioner : That is, we are not required to. He did not say, "O Shaykh, should we ask him?"

The Shaykh : We do not ask him at all, unless the issue is unknown to people, in which case we might say, "Ask." But the principle is that we do not ask, because we have established in the chapter of fatwas, or in the chapter of the manners of the mufti, that it is not required to ask about impediments. It is not required to ask. Otherwise, if we said it is required to ask about impediments, then if a person came to us and asked, "I sold my house to so-and-so for a known price after I owned it," would we have to ask, "Did you sell it after the Friday adhan?" Yes.

The questioner : No.

The Shaykh : It is not required. The important point is that asking about impediments is not obligatory. Asking about what establishes this is necessary. Are there three? Good.
