What is the ruling on wiping and shortening the prayer for one who is disobedient in his travel?

Machine translationRead the Arabic original
The Shaykh : Yes, very well. So what is the ruling on wiping here and breaking the fast? Is shortening the prayer permissible for him or not? We mentioned this and said that if a person travels on a forbidden journey, he wipes for the duration of a resident, which is one day and one night. The one who is disobedient in his travel wipes for only one day and one night, like a person who goes abroad to commit a sin, may Allah protect us from that, or to drink intoxicants. This is a person who is disobedient in his travel; he does not avail himself of the dispensations of travel. This is the view of the majority of scholars and the school of Abu Hanifah. Shaykh al-Islam Ibn Taymiyyah held that he avails himself of the dispensations of travel even if the travel is forbidden. They said this is due to the generality of the evidence. He would be sinful, but the dispensations of travel remain valid for him. However, this is different from the one who is disobedient during his travel. Look, the Arabic language has a great significance. "In his travel" and "during his travel" have a difference between them, do they not, Abd al-Rahman ibn Dawud?

The questioner : Yes, there is a difference.

The Shaykh : And what is the difference?

The questioner : It appears that "in his travel" means he intended with his hand, or rather, he intended the sin when he set out to travel. But "during his travel" means he committed the sin while on his way.

The Shaykh : That is, the one who is disobedient in his travel is the one who intended the sin from the start; he traveled to disobey Allah. As for the one who is disobedient during his travel, he is the one who committed a sin while he was traveling. For example, if a smoker travels, is he disobedient in his travel or disobedient during his travel?

The questioner : Disobedient during his travel.

The Shaykh : During his travel, yes, he is disobedient during his travel. But if he traveled from his town because there is no tobacco in his town, but he went to another town to buy tobacco, then he became disobedient in his travel. This is the difference between the two.

The questioner : The water might be for a pair, O Shaykh.

The Shaykh : Yes, that is right.

The questioner : The defects might be for a pair.

The Shaykh : Yes, that is right.
