The Shaykh : The author says "It is obligatory in camels, cattle, and sheep". The verb "obligatory" refers to zakah; zakah is obligatory in these three categories: camels, second? cattle, and third, sheep.
He says "if they are grazing for the year or most of it". As for grazing, we said that grazing means grazing on what is permitted. "Permitted" here means what grew by the action of Allah (Mighty and Majestic), not by our action. As for what we plant and they graze on, that does not make them grazing animals, just as if a person has, for example, wide areas that he plants and then lets his grazing animals graze in these wide areas, they are not considered grazing animals. The grazing animal is the one that grazes on what? The permitted. And the permitted here is not the opposite of the forbidden; the permitted is what grew by the action of Allah without the action of a human being. Good.
And the author says "the year or most of the year". As for their being grazing for the year, that is clear. As for their being grazing for most of the year, it is because the lesser is included in the greater, and the consideration is given to the greater. So if a person has camels that graze for five months and he feeds them for six months, is there zakah on them as grazing animals? No. If they graze for six months and he feeds them for six months, there is no zakah. If they graze for six months and he feeds them for five, there is zakah. And if they graze for the entire year, there is zakah.
So if someone asks, what is the evidence for the condition of grazing? We say the evidence is the Sunnah. In the hadith of Anas ibn Malik regarding the letter that Abu Bakr wrote concerning alms, he said "And in sheep, in their grazing, for every forty sheep, one sheep". In sheep, then he said "in their grazing." And in this, "in their grazing" is an apposition of explanation, and an apposition of explanation is considered like a description in restricting the described, so it is as if he said "and in the grazing sheep, for every forty sheep, one sheep." Clear? So likewise in camels, in the hadith of Bahz ibn Hakim from his father from his grandfather, that the Prophet (peace and blessings be upon him) said
And in every grazing camel وفي كل إبل سائمة
And even if this hadith did not come, or even if the scholars differ regarding such a chain, the camels are analogized to the sheep, and there is no doubt in that, and the cattle are likewise analogized to them. It is required that they be grazing. Good.
