"And what is forbidden by blood relation is forbidden by breastfeeding, except for the mother of one's sister and the sister of one's son"

Machine translationRead the Arabic original
The Shaykh : Then he said "And what is forbidden by blood relation is forbidden by breastfeeding". The prohibition by breastfeeding, the preposition "by" indicates causality, meaning that what is forbidden due to breastfeeding is what is forbidden due to blood relation. What is the evidence? His saying, Blessed and Exalted is He,
your [milk] mothers who nursed you, your sisters through nursing وَأُمَّهاتُكُمُ اللاَّتِي أَرْضَعْنَكُمْ وَأَخَواتُكُمْ مِنَ الرَّضاعَةِ
[An-Nisa 4:23]
And He did not say "and your daughters who nursed you," yes?

The questioner : ... .

The Shaykh : Why?

The questioner : ... .

The Shaykh : It is not conceivable, yes, because if your daughter nursed you, if she had nursed you, she would not have... a child of hers, but your mother is possible. Fine. And the Prophet (peace and blessings be upon him) said
Breast-feeding makes unlawful (for marriages) the same things that blood tie make unlawful. يحرم من الرضاع ما يحرم من النسب
Sunan Ibn Majah 1937Sahih (Darussalam)
And this is general. List the categories of prohibition by blood relation. How many are they?

The questioner : Seven.

The Shaykh : Seven, and by classification?

The questioner : Four.

The Shaykh : No, by classification? Three categories, because the fourth is mutual oath-swearing in an accusation of adultery. By classification, three categories or four?

The questioner : Four.

The Shaykh : Yes, four. Fine, by classification four. So, what corresponds to them in breastfeeding is forbidden, by his saying
Breast-feeding makes unlawful (for marriages) the same things that blood tie make unlawful. يحرم من الرضاع ما يحرم من النسب
Sunan Ibn Majah 1937Sahih (Darussalam)
Then the author made a correction, a correction of a correction, meaning he corrected and we correct him. "Except for the mother of one's sister and the sister of one's son" And we say there is no need for this exception, because the Messenger of Allah (peace and blessings be upon him) stated it generally
Breast-feeding makes unlawful (for marriages) the same things that blood tie make unlawful. يحرم من الرضاع ما يحرم من النسب
Sunan Ibn Majah 1937Sahih (Darussalam)
Let us look: is the mother of one's sister by breastfeeding, the mother of your sister by breastfeeding, permissible for you?

The questioner : ... .

The Shaykh : The mother of your sister by breastfeeding is permissible for you.

The questioner : Yes.

The Shaykh : Correct or not?

The questioner : Correct.

The Shaykh : Meaning, a woman nursed your brother and you want to marry her, there is nothing wrong with it. But if she were your brother's mother by blood relation, she would not be permissible for you, because she is either your mother or your father's wife. If she is your mother, the matter is clear. If she is your father's wife, she is forbidden to you by affinity. And in that case, there is no need for the exception. Fine, the sister of one's son by breastfeeding?

The questioner : Yes, that is so.

The Shaykh : Sister, yes, or is the sister of one's son by breastfeeding permissible or forbidden?

The questioner : It is lawful.

The Shaykh : Permissible. Meaning, you have a son by breastfeeding who was nursed by a woman who has a daughter. Is it permissible for you to marry her?

The questioner : Yes.

The Shaykh : The sister of your son by breastfeeding, O son of the lawful?

The questioner : Yes.

The Shaykh : It is permissible, because there is no cause of prohibition between you and her. Because the sister of your son by breastfeeding, if she were by blood relation and she is your son's sister, is she forbidden to you or not?

The questioner : Yes.

The Shaykh : Because if she is your son's sister by breastfeeding, she is your wife's daughter, a stepdaughter. Yes, if she is your son's sister from the mother, she is a stepdaughter. And if she is your son's sister from the father, she is your daughter. And on this basis, there is no need for this exception. And for this reason, this exception is considered out of place from two aspects. First, that this is like a correction of the Prophetic hadith: "What is forbidden by breastfeeding is forbidden by blood relation." And second, that these prohibited women who were excepted are not prohibited by blood relation; they are prohibited by affinity. And here it is appropriate to mention a useful rule, which is that breastfeeding only affects the nursed person and his descendants. Breastfeeding affects the nursed person and his descendants. The nursed person, yes, tell us: the nursed person has ancestors and descendants, and what else? He has collaterals. Breastfeeding does not affect anything except his descendants. And in it also, as for his ancestors and collaterals, they have no effect from breastfeeding at all. And for this reason, it is permissible for the brother of the nursed person to marry his mother, and it is permissible for the father of the nursed person to marry her mother, the mother of his son who nursed him. Is that clear, everyone?

The questioner : Yes.

The Shaykh : If you know this rule.
