And the mother of his wife and her grandmothers are forbidden by the marriage contract, and her daughter and her granddaughters by consummation

Machine translationRead the Arabic original
The Shaykh :"And the mother of his wife and her grandmothers" means, even if they are distant, by the marriage contract. The mother of the wife means, if a man marries a woman, then her mothers and grandmothers are forbidden to him. Is it forbidden forever, or for a limited time?

The questioner : Forever.

The Shaykh : Forever. "They are forbidden by the marriage contract" These three are forbidden by the marriage contract.
He said, "And her daughter and her granddaughters by consummation". Her daughter, the daughter of whom? The daughter of the wife, and her granddaughters by consummation. Yes, and the evidence for this is the saying of Allah the Exalted
And do not marry those [women] whom your fathers married, except what has already occurred. Indeed, it was an immorality and hateful [to Allah] and was evil as a way.
[An-Nisa 4:22]
and His saying, Blessed and Exalted is He,
Prohibited to you [for marriage] are your mothers, your daughters, your sisters, your father's sisters, your mother's sisters, your brother's daughters, your sister's daughters, your [milk] mothers who nursed you, your sisters through nursing, your wives' mothers, and your step-daughters under your guardianship [born] of your wives unto whom you have gone in. But if you have not gone in unto them, there is no sin upon you. And [also prohibited are] the wives of your sons who are from your [own] loins
[An-Nisa 4:23]
. These four, as for the limit, we say: if a man marries a woman, it is forbidden to him alone her ancestors by the contract and her descendants by consummation. And it is forbidden to her alone his ancestors by the contract and his descendants by the contract as well. So the relatives by marriage are four types. The ancestors of the husband and his descendants, upon whom?

The questioner : It is obligatory upon the husband.

The Shaykh : Upon the wife alone. By the contract, or by consummation?

The questioner : By the contract.

The Shaykh : By the contract. The ancestors of the husband. No, pay attention. The ancestors of the wife and her descendants are upon the husband alone. As for the ancestors, it is by the contract, and as for the descendants, it is by consummation. The ancestors of the husband and his descendants are upon the wife. Is this by the contract or by consummation?

The questioner : By the contract.

The Shaykh : By the mere contract. Perfect. So, the relatives by marriage, memorize them, are four types. The first type is the ancestors of the husband, the second type is the descendants of the husband, and the third type is the ancestors of the wife. These three are forbidden by the mere contract. The fourth type is the descendants of the wife; these are forbidden by consummation. The evidence for that is the saying of Allah the Exalted
and your step-daughters under your guardianship [born] of your wives unto whom you have gone in. But if you have not gone in unto them, there is no sin upon you.
[An-Nisa 4:23]
. All right, let us give examples. A man marries a woman who has a mother and a daughter, and he divorces her before consummation.

The questioner : Her mother is forbidden...

The Shaykh : Pay attention, oh...

The questioner : ... .

The Shaykh : A man marries a woman who has a mother and a daughter, and he divorces her before consummation. Who is forbidden to him?

The questioner : The mother.

The Shaykh : The mother and the daughter?

The questioner : The daughter is not forbidden.

The Shaykh : The daughter is not forbidden because he did not consummate the marriage. All right, a man marries a woman and divorces her before consummation, and he has a father and a son. Are they forbidden to her?

The questioner : Yes.

The Shaykh : Did he divorce her before consummation?

The questioner : Yes.

The Shaykh : Did he divorce her before consummation?

The questioner : Yes.

The Shaykh : Why? Because consummation is not required except for the descendants of the wife only. All right, a man marries a woman. Is it permissible for her to marry his brother if he divorces her?

The questioner : Yes.

The Shaykh : Why?

The questioner : Because she is not forbidden to him.

The Shaykh : Because his brother is not an ancestor of his nor a descendant. All right, is it permissible for him to marry her sister if he divorces her?

The questioner : Yes.

The Shaykh : Yes, because she is not an ancestor of the wife nor a descendant. Perfect. All right.
