Q: My wife, who is the mother of my children, was informed that I had proposed to another woman. She became upset and said to me: “May Allah forbid you to me” three times, meaning that I would not sit with her, eat with her, or be with her while I wanted to marry another woman. During the discussion with her at that same moment and place, she swore an oath, saying: “By Allah, you will not propose to another woman or contract a marriage with another while I am under your protection.” She repeated this several times. This is what happened from her. I have actually proposed to and contracted a marriage with another woman, and my wife, the mother of my children, remains as she is, in my house with her children. We eat, drink, and sit together with our children in our house. I ask you to inform me of the legal ruling in this matter, and what is the expiation for what my wife uttered in the two previous expressions, provided that this fatwa is written so that we may read it and be convinced by it? May Allah reward you with good.
A: A woman does not have the right to divorce, nor to forbid herself to her husband. As for the oath she swore, she must pay the expiation for an oath, which is: feeding
ten poor people from the middle of what you feed your families, or clothing them, or freeing a believing slave. If she cannot find that, then she must fast for three days. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
