Discussion of the Prohibitions in Marriage.

Machine translationRead the Arabic original
The Shaykh : In the name of Allah, the Most Gracious, the Most Merciful. All praise is due to Allah, Lord of the worlds, and may Allah send prayers and blessings upon our Prophet Muhammad, and upon his family and his Companions, and those who follow them with excellence until the Day of Judgment.
We have previously stated that the prohibitions in marriage are divided into two categories: those that are permanent and those that are temporary. As for the permanent prohibitions, there are four types, is that correct or not? Good. The author (may Allah have mercy on him) mentioned the temporary prohibitions as the sister of the wife, the aunt of the wife, and the maternal aunt of the wife, whether the wife is in his possession or in her waiting period. We mentioned that this phrasing is questionable because it differs from the Quranic and Prophetic phrasing. What is the Quranic and Prophetic phrasing? It is the prohibition of combining. The forbidden act is combining. Allah the Exalted said:
and that you take [in marriage] two sisters simultaneously وأن تجمعوا بين الأختين
[An-Nisa 4:23]
And the Prophet (peace and blessings be upon him and his family) said:
One should not combine a woman and her father's sister, nor a woman and her mother's sister in marriage. لا يُجمع ين المرأة وعمتها ولا بين المرأة وخالتها
Sahih Muslim 1408a
Good. If a contract is made for the two sisters, or for the aunt and her brother’s daughter, or for the maternal aunt and her sister’s daughter, if they are contracted under one contract, then both are invalid. Or if they are in two contracts and one did not precede the other, then likewise both are invalid. Good. The author (may Allah have mercy on him) said, good. What if one of them is delayed?

The questioner : ... .

The Shaykh : The later one is invalid and the first one is valid.
