There is scholarly disagreement on this issue. Some scholars said: If a person enters the state of Ihram for Hajj and performs Tawaf and Sa'y based on the initial intention—meaning he does not renew his intention at the time of Tawaf or Sa'y—then his Hajj is valid. He explained his position by saying: Tawaf, Sa'y, standing at 'Arafah, stoning the pillars, and staying overnight are all parts of the act of worship, so the initial intention is sufficient. Just as a person who prays and intends at the start of the prayer that he is entering the prayer is not required to intend the bowing, prostration, standing, or sitting, because they are parts of the act of worship, so it is with Hajj. This opinion should be used for issuing fatwas in cases of dire necessity. For example, if a person comes to you seeking a ruling and says, "I entered the Sacred Mosque and performed Tawaf, and at that moment I did not have an intention," then in this case, you should rule that he owes nothing and that his Tawaf is valid. However, when there is no constraint, it should be said: It is better if you intend it.
