The Shaykh : In it, the Prophet (peace and blessings be upon him) swore three times, saying:
By Allah, he does not believe! By Allah, he does not believe! By Allah, he does not believe!" It was said, "Who is that, O Allah's Messenger (ﷺ)?" He said, "That person whose neighbor does not feel safe from his evil. والله لا يؤمن، والله لا يؤمن، والله لا يؤمن، قالوا: مَن يا رسول الله؟ قال: من لا يأمن جارُه بوائقَه

: meaning his treachery, betrayal, injustice, and aggression. So the one whose neighbor does not feel safe from that is not a believer, and if he does it and commits it in action, it is more severe.
And in this is evidence for the prohibition of aggression against the neighbor, whether that is by speech or by action. As for by speech: it is that he hears from him what disturbs and worries him, such as those who turn on the radio or television or other things that are heard and disturb the neighbors. This is not permissible for him, even if he turns it on to the Book of Allah, and it is something that disturbs the neighbors with its sound, then he is an aggressor against them, and it is not permissible for him to do that.
And as for [action], it is by throwing trash around his door, and squeezing him at the entrances of his door, or by knocking, or what is similar to that which harms him. And from this also, if he has a date palm or a tree around his neighbor's wall, and he waters it until he harms his neighbor with this watering, then that is among the misdeeds of the neighbor, so it is not permissible for him.
So it is forbidden for the neighbor to harm his neighbor with anything. If he does so, he is not a believer. The meaning is: that he is not characterized by the attributes of the believers in this matter in which he opposed the truth.
And as for the third right: what he mentioned in the hadith of Abu Hurayrah that the Prophet (peace and blessings be upon him) said:
No one should prevent his neighbor from fixing a wooden peg in his wall. لا يمنعنَّ جارٌ جاره أن يغرز خشبه في جداره
Sahih al-Bukhari 2463
And if he does and prevents it, he will be forced to have the wood placed over his nose against his will. For this reason, Abu Hurayrah said: "Why do I see you turning away from this? By Allah, I will throw it between your shoulders": meaning, whoever is not allowed to place wood on his wall, we will place it on his back between his shoulders. And this was said by him (may Allah be pleased with him) when he was the governor of Madinah in the time of Marwan ibn al-Hakam, for Abu Hurayrah was the governor of Madinah, so he used to say this statement to the people.
And this is similar to what the Commander of the Faithful 'Umar ibn al-Khattab said: regarding the case that occurred between Muhammad ibn Muslimah and his neighbor, where he wanted to run water from his garden to his garden, and the neighbor's garden was between them, so the neighbor prevented him, saying: Do not run water with my land. So they both went to 'Umar, and he said: "By Allah, if you prevent him, I will run it over your belly", and he compelled him to run the water, because running water does not have harm. Every garden is planted, so if the water runs, the land benefits and the plants around the water channel benefit and the neighbor benefits. Yes, if the neighbor wants to build on it and says: I do not want you to run water on the land, then he has the right to prevent it. But if he wants to plant it, the water does not add to it except good.
So the rights of the neighbors are that it is obligatory to be good to them as much as possible, and it is forbidden to aggress against them with any aggression. And in the authentic hadith from the Prophet (peace and blessings be upon him), he said:
he who believes in Allah and the Last Day should treat his neighbour with kindness من كان يؤمن بالله واليوم الآخر فليكرم جاره
Sahih Muslim 47a
, and success is from Allah.
