The Shaykh : It appears that it is the one on the right for the sake of prioritizing the right side, but it was said to him: "Give it to the older one," meaning: give it to the elder. So, if people are in front of you, start with the elder, do not start with the one on the right. But if they are sitting on the right and on the left, start with the one on the right.
And with this, the evidence indicating the consideration of age, meaning: respecting the elder, and the evidence indicating the consideration of the right side, meaning: respecting the one on the right, are reconciled. So we say: if the situation is as it came from the Prophet (peace and blessings be upon him):
That he had a vessel with which he was drinking, and on his left were the elders and on his right was Ibn 'Abbas, so he gave it to Ibn 'Abbas (may Allah be pleased with him), because he was the one on the right, and he said: The ones on the right, the ones on the right. أنه كان معه إناء يشرب منه، وعلى يساره الأشياخ وعلى يمينه ابن عباس، فأعطاه ابن عباس رضي الله عنه، لأنه هو الأيمن وقال : الأيمنون الأيمنون
: then if it is like this, give it to the one on your right. As for those in front of you, start with the elder, as indicated by the Sunnah. And this is the way of reconciling between them.
Then, if a person gives it to the elder, meaning he pours the cup and gives it to the elder, who is given after him? Is it the one on the right of the elder, who is on the left of the pourer, or the one on the right of the pourer?
We say: start with the one on the right of the pourer, even if he is on the left of the elder, because if we consider prioritizing the right side after respecting age, the one on your right is the one on the left of the person opposite you, so you start with him. Unless some of them allow it to others and say: give it to so-and-so, give it to so-and-so. Then the right belongs to them; they have the right to waive it. And Allah knows best.
