A person has a debt, and he has gold for which a lunar year has passed, and he wants to pay off the debt before the end of the lunar year

The Shaykh: Yes.

The questioner : In fact, this is two questions, meaning I was asked about them so that I could inquire from you about their answers.

The Shaykh: Go ahead.

The questioner : Two questions about zakah. The first question: A person has two hundred grams of gold, and the lunar year for them ends, for example, at the end of Ramadan. He became liable for a debt of three hundred dinars before Ramadan, but he did not sell the two hundred grams of gold so as not to incur a loss, because the price was low. So he postponed selling the two hundred grams until after Ramadan. Now, is zakah obligatory on the two hundred grams because the lunar year has passed for them and they are in his possession, or is zakah obligatory excluding the three hundred dinars?

The Shaykh : He does not exclude anything as long as the excluded amount remains in his possession and ownership, such that if his term were to arrive and his heirs inherited it, this wealth would transfer to the heirs. Therefore, one of two things is necessary: either he hastens to pay his debt, with the intention of not circumventing zakah, and in that case, as a natural result of paying his debt, the nisab decreases and zakah is not obligatory on him. But since he did not do any of that, and this wealth remained with its full nisab and the lunar year passed completely, he must pay zakah from this wealth that is in his possession.

The questioner : Now, the second question.

The Shaykh: Yes.
