Answer: If the deceased’s wealth was acquired through a forbidden means, such as plundering, theft, or the wars of the pre-Islamic age of ignorance, it is not permissible for the heir to consume it, and he is obligated to return it to its rightful owners. If he does not know them, he should give it in charity on their behalf if they are Muslims. However, if the deceased was a disbeliever when he acquired the wealth, and then he embraced Islam while it was still in his possession, it belongs to his Muslim heirs, unless a specific item is identified as belonging to a particular Muslim, in which case it must be returned to its specific owner, according to the more correct of the two opinions of the scholars.
