Q: My husband has passed away, leaving behind a sum of money amounting to three million riyals. I am the guardian of my four minor children, and due to the dispute among the heirs from another wife, the matter has been delayed
The division of this amount was delayed for a period of approximately two and a half years, then each of the heirs took his or her share of the money. Our question is: Is zakat obligatory on this money, or is it considered wealth that is in dispute? If zakat is obligatory on it, is it to be paid for the two years or for one year? May Allah preserve you.
A: If it is as you mentioned, that the wealth was left by the deceased and a dispute arose among the heirs, causing its division to be delayed for about two years, then its zakat is due on each heir in his or her share, provided that the share reaches the nisab (minimum threshold) on its own or when combined with other wealth the heir possesses, such as cash or trade goods, whether the heir is a minor or an adult. The lunar year (hawl) begins from the time of the deceased's death. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
