Question: From 'Abd al-'Aziz ibn 'Abd Allah ibn Baz to the honorable brother, the virtuous Shaykh, Assistant Head of the Courts of the Hail Region, may Allah guide you to all good, amen.
Peace be upon you, and Allah's mercy and blessings. After that:
O Beloved, your noble letter dated 3/12/1392 AH, which is a response to my letter number (2103) dated 29/11/1392 AH, has been received, may Allah guide you. We have reviewed it and the attached documents concerning the divorce of husband Z. A. S. from his wife, and we found that the situation is summarized as follows: a discussion, dispute, and cursing occurred between them, which stirred up his feelings and anger. He then said to her: "Go, with thirty thousand divorces," then he said to her: "Go, with sixty thousand divorces." Then he came to us with the paper in which you recorded the description of his aforementioned divorce. When we referred the matter to your eminence to complete some procedures, and he returned to Hail, his mother asked him what had happened regarding his inquiry, and she spoke to him at length. He answered her by saying: "She is divorced with one thousand divorces." Witnesses E. F. N. and A. M. A., who are known for their integrity, testified before your eminence that the aforementioned husband is quick-tempered, that he is always angry, and that when he becomes angry he loses his sense, and it is not ordinary anger; he gets angry over the slightest thing. Also, M. S. and A. M., whose integrity is known to you, appeared before your eminence and testified widely that the aforementioned Zayd tore up the money sent to him by his mother when he was angry.
Answer: Based on this, I issued a ruling to him that his aforementioned divorces did not take effect, and that his wife remains in his marriage bond, because the scriptural evidence indicates that intense anger prevents the consideration of the divorce, as is not hidden. Among this is the hadith narrated by Imam Ahmad, Abu Dawud, and Ibn Majah, and authenticated by al-Hakim, from 'A'ishah (may Allah be pleased with her), from the Prophet (peace and blessings be upon him), that he said:Sunan Ibn Majah 2046Hasan (Darussalam) A group of scholars, including Imam Ahmad, interpreted "compulsion" as coercion and anger.
I hope that your eminence will inform everyone of this, and advise the husband to fear Allah and be cautious of the causes of anger, and to seek refuge in Allah from the accursed Shaytan when such feelings arise. May Allah reward you and thank you for your efforts.
And peace be upon you and the mercy of Allah and His blessings.
