Question: The husband and his wife's brother came to me, and the aforementioned husband admitted that he had divorced his wife with one divorce on 13/8/1391 AH. He wrote a document to that effect, then took her back on 18/8/1391 AH. Then he divorced her with two divorces using a single expression on 10/11/1393 AH. He wrote a document to that effect and did not divorce her beyond that. When his aforementioned brother was asked, he answered that he did not know of any divorce by the husband other than what was mentioned, and as for the aforementioned divorce, he did not know of it except from the two documents the husband wrote regarding it. He stated that he and his sister desire her to return to the aforementioned ex-husband if a legal fatwa is found.

Answer: Based on that, I issued a fatwa to the aforementioned husband that his last divorce on the aforementioned wife resulted in one divorce, which is added to the previous divorce, and she has one divorce remaining, and he can return to her with a new marriage contract with its valid conditions in the Shari'ah; because it is authentically reported from the Prophet (peace and blessings be upon him) in the hadith of Ibn 'Abbas (may Allah be pleased with him) what indicates that such a last divorce does not result in more than one, because it is in the meaning of the three grouped together. The aforementioned wife came to me and confirmed her brother's and husband's description of what happened, and she stated that she has no objection to returning to him. Then, in light of that, the aforementioned brother issued the offer of marriage for the aforementioned sister to the aforementioned husband, and the ex-husband issued the acceptance of the marriage with a definite mahr, as admitted by everyone, and thus the aforementioned divorced woman became a lawful wife to the aforementioned ex-husband. I. A. H. and I. A. M. witnessed the presence of everyone and the issuance of the aforementioned marriage contract in the aforementioned manner.
