There is no harm in marrying the daughter of one’s maternal aunt through breastfeeding

Machine translationRead the Arabic original
Question: S. I. M. came to me and expressed his desire to marry N. M. D., but he was informed that H. E. L. had breastfed his mother (F. M. E.) and that the aforementioned H. E. is the grandmother of the aforementioned N. M.—her mother’s mother. However, this breastfeeding was not established; for E. M. E.—who is his maternal aunt and much older than his mother—was brought to us and stated that she does not know of this breastfeeding and does not remember it, and that they did not know the aforementioned H. E. until after F. M. had weaned her child, and a brother was born to her afterward. Before that, there was no connection, no neighborhood, and no acquaintance at all between them. Likewise, her grandmother L. E. M.—who is the mother of (F)—informed us that there was no breastfeeding of her daughter by (H), and that they did not recognize (H) until after a younger brother was born to F. M.
Since these two relatives of F. M. denied her breastfeeding, and since no proof was found, and no one claimed the actual breastfeeding that would prohibit marriage, there is no impediment to the marriage of the children of (F) to the daughters of (H), whether through breastfeeding or birth—even if (H) is currently missing. The same applies to F. M., since L. E. M. is her mother and took charge of her custody, and I know who contacted her, until the supposed breastfeeding is proven.

And may Allah send blessings and peace upon Muhammad, his family, and his Companions.

Answer: In the name of Allah, the Most Gracious, the Most Merciful.
If the situation is as Shaykh Abdullah mentioned above, there is no harm for the aforementioned (S) in marrying the aforementioned (N), even if the breastfeeding of H. to F. is proven; because the aforementioned (S) would be the maternal cousin of (N) if the breastfeeding is proven, and there is no harm in a man marrying his maternal aunt’s daughter, whether by blood or by breastfeeding, by explicit text and scholarly consensus.
Said by the one who dictated it, the poor servant of Allah the Exalted, Abdulaziz ibn Abdullah ibn Baz, may Allah forgive him.
