What is the ruling on one who accuses his wife of zina?
Machine translationRead the Arabic original
Question:
What is your opinion, may Allah reward you, regarding a man who accused his wife of zina while she is innocent of it, simply because he did not see blood on the night of the wedding, and she is living with him in torment due to his words and his suspicion? Should she separate from him? Or what do you advise her to do?
Answer:
If he accuses her of zina, she should demand the hadd punishment for false accusation so that he is flogged eighty lashes; she should request the court to impose the hadd of eighty lashes on him, unless she forgives and overlooks it, and Allah guides him, and he stops the obscene talk, in which case there is no harm. Otherwise, she has the right to demand that he be flogged eighty lashes, unless zina is proven by four witnesses, or he performs li'an before the court.
And if she wants separation, there is no harm. If he faults her, harms her, and accuses her, she has the right to request divorce, even if she gives him some money, and he separates from her and she finds relief from him.
