Question: I have a paternal cousin who has a daughter. This cousin of mine was breastfed by my elder sister, who is older than me. Is it permissible for me to marry his daughter? Or is she forbidden to me because her father was breastfed by my elder sister, and her father is my brother?

Answer: If the situation is as the questioner described, and the infant mentioned was breastfed by the questioner's mother five times or more while he was within the first two years, then it is not permissible for the questioner to marry his daughter. This is because, given the circumstances described, he has become her paternal uncle through breastfeeding. It is authentically reported from the Messenger of Allah (peace and blessings be upon him) that he said:
on account of fosterage as one is Mahram on account of consanguinityيحرم من الرضاعة ما يحرم من النسب
Sahih Muslim 1445i
, and he (peace and blessings be upon him) said:
Suckling applies only (to infants) during the first two years (of their life).لا رضاع إلا في الحولين
Bulugh al-Maram 8:198
. Aisha (may Allah be pleased with her) said: "It was among what was revealed in the Qur'an that ten breastfeedings make marriage forbidden, but this was abrogated by five known breastfeedings. The Prophet (peace and blessings be upon him) passed away while the matter remained as such." This was narrated by Muslim in his Sahih, and by al-Tirmidhi, and this is his wording.
