Question:
Your Eminence! This questioner from Yemen, Najib Ahmad, says: I was breastfed by my grandmother. Is it permissible for me to marry the daughters of my paternal uncles, or my paternal aunts?
Answer:
If you were breastfed by your paternal grandmother, your father's mother, with a complete legal breastfeeding of five breastfeedings or more within the two-year period, you become a brother to your father and to your paternal uncles. And if your grandmother is your mother's mother, if you were breastfed by her five times or more within the two-year period, you become a brother to your mother and to your maternal aunts.
Breastfeeding is like lineageSunan Ibn Majah 1937Sahih (Darussalam) So if you were breastfed by your father's mother, you become a brother to your father, a brother to your paternal uncles, and an uncle to the daughters of your paternal uncles. You are an uncle to them, and they are not lawful for you.
Likewise, if you were breastfed by your maternal grandmother, your mother's mother, with legal breastfeeding, five times or more within the two-year period, you become a brother to your mother, a brother to your maternal aunts, and a maternal uncle to their daughters. You have no right to marry them; you are a maternal uncle to them. The Messenger of Allah (peace and blessings be upon him) said:Sunan Ibn Majah 1937Sahih (Darussalam) May Allah send blessings and peace upon him.
The presenter: May Allah send blessings and peace upon him. He said: Your Eminence! Extending the previous question: I have contracted the marriage with my paternal aunt's daughter, but I have not yet entered upon her. What is the ruling on this contract in this case?
The Shaykh: If you were breastfed by your paternal grandmother, your father's mother, with legal breastfeeding, five times or more, and you were within the two-year period, then the marriage is invalid; it is not valid. Because in that case, you are an uncle to her, a brother to her father, a brother to your paternal uncle, a brother to your father, and an uncle to the daughters of your paternal uncles; so the marriage is invalid.
The presenter: May Allah reward you, Your Eminence.
