Peace be upon you, and Allah’s mercy and blessings, and after that:
O honorable Shaykh: An accident happened to me and my family on the evening of Monday, corresponding to 23/3/1415 AH, on the Khumais Mishit road, while I was coming from (Ahd Rafidah). When I was traveling in my lane with my family, a traffic accident suddenly occurred between me and another person who was driving a car in the opposite direction in the second lane. After that, he overturned in my lane, then crossed the median between the two lines while in an overturned state, and then collided with me and my family while we were in our lane. The person died after that.
Traffic authorities, after inspecting the accident, determined that the error was 100% on the part of the deceased. His family has relinquished their rights to him religiously, and I have relinquished my rights to him religiously. Do I have to fast, since I had no sin in the occurrence of the accident? May Allah reward you with good.
Answer: And upon you be peace, and Allah’s mercy and blessings, after that:
If the situation is as you described, then you owe no expiation, and I ask Allah to forgive everyone.
