The Ruling on the Monetary Blood Money Paid to the Heirs of the Deceased
Machine translationRead the Arabic original
Fatwa No. ( 6647 )
Q 1: What is the ruling on the monetary blood money paid to the heirs of the deceased?
A 1: It is distributed among the heirs of the deceased just as his estate is distributed among them.
Q 2: Do I have to fast after paying the blood money? What is the amount, and is it consecutive or not? Is it possible to divide it or feed people on my behalf?
A 2: You are obligated to pay the expiation for accidental killing, which is freeing a believing slave. If you cannot find one, you must fast for two consecutive months. It is not valid to divide the fasting of these two months, and feeding the poor does not suffice as expiation for accidental killing; because that has not been established in the Book of Allah or in the Sunnah of His Messenger (peace and blessings be upon him), and your Lord is not forgetful.
Q 3: If the accident was shared in proportion between the drivers, does it have a relation to the two questions?
A 3: If the accident was shared in proportion between the drivers, then each participant in the killing is obligated to pay a share of the blood money according to his proportion. As for the expiation, each participant in the accidental killing is obligated to pay the expiation, even if his proportion is smaller. As for the one whose fault was 100%, he alone is obligated to pay the expiation, and his 'aqilah (kin group) is obligated to pay the blood money. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
