Question: His Eminence the Shaykh / Abdul Aziz ibn Abdullah ibn Baz - the Grand Mufti of the Kingdom of Saudi Arabia (may Allah preserve him).
Peace be upon you, and Allah’s mercy and blessings, and after that:
I am sending this message to your Eminence, in which I inform you: that I am a man who went to perform the Fajr prayer in the House of Allah the Sacred, and after I finished the Fajr prayer, I returned to my car and found it reversing backward, and as a result of the car reversing, a man and a woman died.
One of the shaykhs in the urgent court ruled against me to fast for four months or free two slaves. Since I am a man suffering from diabetes -may Allah protect you from this evil disease- and when I fast, I feel hunger, dizziness, and trembling in my body, which forces me to break the fast, and if I do not break the fast, it may result in dizziness due to hunger. I am a man retired from the military service with a salary of 1500 riyals, which is not enough for my family's expenses, and I support a large family consisting of twelve people, and I have many debts amounting to: 360,000 riyals -three hundred and sixty thousand riyals- which is due to housing for me and my children.
Therefore, we ask your Eminence to issue a fatwa to me on this matter, in which I have become confused; since I cannot bear fasting, or performing the payment to free the slaves. I ask your Eminence to guide me in this matter, and may Allah preserve you and care for you.
Answer: And upon you be peace, and Allah’s mercy and blessings, after that:
Allah says : [Al-Taghabun:16], and He the Exalted says: [Al-Baqarah:286] and the expiation becomes a debt in the obligation until you are able to free [the slaves] or fast. May Allah make your matter easy, and may He suffice you.
And peace be upon you and the mercy of Allah and His blessings.

فَاتَّقُوا اللَّهَ مَا اسْتَطَعْتُمْAllah does not charge a soul except [with that within] its capacity
