Ruling on the injured party taking insurance money

Machine translationRead the Arabic original
Question:
If he is involved in an accident, and he does not take anything, for example, he gives it to the other party, is it permissible for the insurance company with which he has insurance to give it to the other party without him taking anything?

Answer:
This is a matter for consideration; because this transaction is gambling, a transaction of maysir (gambling), but the excess is not for him. If they pay him an excess over what he paid, it is not for him, but he is compelled and it is not by his choice. If it is easy for him to get rid of this, and if not, then there is nothing on him, if Allah wills.
