Is it permissible for a person to work in a civilian military position, where the person works as a driver for one of the state officials?

Machine translationRead the Arabic original
The questioner : But his clothing maintains the Islamic style, the thobe and the beard, and everything, but he is a civilian in the military. Is it permissible for him to remain in this position?

The Shaykh : What is the job of a civilian in the military so that we can know the answer?

The questioner : That is the problem, our Shaykh.

The Shaykh : Yes.

The questioner : The Shaykh Al-Albani.

The Shaykh : That is the problem.

The questioner : But, our Shaykh, naturally, there is a point you could say, you could say, "O Shaykh, do not be an employee."

The Shaykh : Yes, but now, the one who is an employee, the imam of a mosque, is an employee. The one who is a preacher at a mosque is an employee.

The questioner : Correct, yes, that is right.

The Shaykh : And so we need to know what the job of a civilian in the military is.

The questioner : Yes, that is right. All right, our Shaykh, would you allow us to let him speak with you?

The Shaykh : By Allah, if you delay him.

The questioner : I, by Allah, know, our Shaykh, but the young man, as you say, is very dear to us, and, praise be to Allah, he serves us a lot. And he means he knows that your time does not allow for this, so he called me about something and said, "I wish you would ask the Shaykh for me." And we need the answer today. So tonight, your presence, naturally, is busy; you will not open the line, I imagine.

The Shaykh : Allah knows best.

The questioner: Yes.

The Shaykh : In any case, let him call.

The questioner : May Allah reward you, our Shaykh.

The Shaykh : May Allah preserve you.

The questioner: Peace be upon you.

The Shaykh: And upon you peace.

The questioner : How are you, O Shaykh?

The Shaykh : Praise be to Allah, I am well. How are you?

The questioner : By Allah, praise be to Allah.

The Shaykh: All right.

The questioner : I tell you, I love you for the sake of Allah, O Shaykh, first of all.

The Shaykh : May Allah love you for the sake of Whom you loved me.

The questioner : May Allah reward you with good.

The Shaykh : And secondly.

The questioner : There is a question.

The Shaykh: Yes.

The questioner : My Shaykh, we have a question.

The Shaykh : Yes, yes.

The questioner : We know your response regarding entering the military in the first place.

The Shaykh : Yes, that is right.

The questioner : That it is not permissible.

The Shaykh : Yes.

The questioner : But entering it as a civilian.

The Shaykh : Yes.

The questioner : A civilian employee.

The Shaykh : Yes.

The questioner : What is its ruling?

The Shaykh : A civilian employee, what does that mean? What is his work?

The questioner : His work is either a driver or a clerk.

The Shaykh : All right, he is not subjected to military laws.

The questioner : Military laws do not apply to him.

The Shaykh : For example, he is not required to attend one of the ceremonies they hold, in which, for example, the salute to the flag and the salute to the commander occur, other than the Islamic greeting, and the like.

The questioner : I ask for your brother; he is with me.

The Shaykh : Yes, may Allah guide you, and you...Abu Layla .

The questioner : Your questions, O Shaykh, are frankly very precise. May Allah reward you with good.

The Shaykh : So it is not you who want to be employed?

The questioner : Yes, the brother is with me.

The Shaykh : Yes, give him to me.

The questioner : In this matter, I was asking about him.

The Shaykh : All right, give him to me, let me speak with him.

The questioner : All right, go ahead, O Shaykh.

Another questioner : Hello.

The Shaykh: Peace be upon you.

The questioner: Peace be upon you.

The Shaykh : And upon you be peace and the mercy of Allah.

The questioner: Peace be upon you.

The Shaykh: And upon you peace.

The questioner : I hope you are comfortable, O Shaykh.

The Shaykh: Yes.

The questioner : Shaykh, I am in the Interior Ministry as a civilian. All right, their laws are not applied to me, and what are they called?

The Shaykh : For example, you...

The questioner : ... Hello.

The Shaykh : You do not attend military ceremonies.

The questioner : No... ceremonies.

The Shaykh: Yes.

The questioner : No, no, I do not attend ceremonies.

The Shaykh : All right, what is your work exactly?

The questioner : Driver.

The Shaykh : Driver.

The questioner : And I do not work now at the southern centers. All right, I do not work there, and what is it called? And now it is not operating, it is not operating, and I do not work, and I receive my salary while I am sitting, meaning I do not work until now, the work has not started.

The Shaykh : All right, now you do not work, but later, if you work, what is your job? You say you are a driver. All right, do you have a commander? Do you have an officer? A person in charge?

The questioner : I have a person in charge.

The Shaykh : A military commander.

The questioner : No, no, a civilian.

The Shaykh : A civilian.

The questioner : Yes.

The Shaykh : If you are in your work and you do not encounter a violation of the Shari'ah, then it is permissible.

The questioner : No, no, by the will of Allah, I will not encounter one.

The Shaykh : Give me your friend who speaks with me. Give me your friend.

The questioner : I will give you my friend.

The Shaykh : Yes.

The questioner: Peace be upon you.

The Shaykh : And upon you be peace, and Allah's mercy and blessings, my brother. I hope you understand me well, and in your expression, you understand me well.

The questioner : Thank you, may Allah reward you with good.

The Shaykh : I say, our Lord - Mighty and Majestic - says:
And cooperate in righteousness and piety, but do not cooperate in sin and aggression. وَتَعَاوَنُوا عَلَى الْبِرِّ وَالتَّقْوَى وَلَا تَعَاوَنُوا عَلَى الْإِثْمِ وَالْعُدْوَانِ
[Al-Ma'idah 5:2]
. I do not know what the circumstances are surrounding this driver who will work as a driver in your country, and what are the works or conditions to which he may be exposed. All of this is unknown to me, and it seems that it is also unknown to you. And so I cannot say that it is definitely permissible or definitely not permissible. But I say, first, He - the Exalted - said:
but do not cooperate in sin and aggression وَلَا تَعَاوَنُوا عَلَى الْإِثْمِ وَالْعُدْوَانِ
[Al-Ma'idah 5:2]
. So if this driver encounters a violation of the Shari'ah one day, then it is not permissible for him to continue in his work. Is that understood up to here?

The questioner : Yes, I am with you.

The Shaykh : All right, so if we assume that he entered as a driver and registered with them, can he resign on any day he wishes?

The questioner: Yes.

The Shaykh : He can resign.

The questioner : He can, yes, by the will of Allah.

The Shaykh : Ah, so if he encounters a violation of the Shari'ah, it is obligatory for him to resign immediately. And in my opinion, what I understood from our brother...Abu Layla : ...is that his clothing and his beard are preserved. But in my opinion, the matter will not continue in that way, and he will be ordered by his superior to change his appearance and demeanor. And at that time, he must submit his resignation immediately. And if he knows in advance that his resignation will not be accepted, then he should not apply for such a position.

The questioner: Yes.

The Shaykh : I hope you understood well.

The questioner : Yes, if Allah wills.

The Shaykh : So I say to you, bidding farewell, peace be upon you.

The questioner : O Shaykh.

The Shaykh: Yes.

The questioner : Can we take some of your time? By Allah, this opportunity frankly does not come around.

The Shaykh : Yes, may Allah bless you, but we are now busy with knowledge.

The questioner : May Allah reward you with good.
