After that: I refer to your inquiry registered with the Department of Scholarly Research and Ifta under number 2191, dated 10/6/1407 AH, in which you ask about the ruling on building a mosque near graves so that the people of the graves may benefit from it, the ruling on praying in this mosque, and the ruling on praying in a mosque that contains graves.
A: I inform you that it is not permissible to build mosques on graves, nor is it permissible to build mosques near graves for the purpose of the people of the graves benefiting from the mosque being built next to them.
However, if the graves are outside the mosque, and a road or the like separates them from it, and the mosque was not built for the sake of those graves, then there is no blame on praying in it.
