The Shaykh : A man who has performed ablution is in a time of cold winter. They say, "Let him warm up, because there is severe cold right now." The litigants say, "No, sit and judge between us. Once you have judged between us, you will forget the cold, because you want to seek shelter, so you will forget the cold." He must say, "No, I will go and warm up, or put on more clothes, and then come back to judge between you." Disturbing heat: perhaps you have seen the heat? He said it is disturbing, and the cold is painful, because the cold is severe and bites the body. That is why a person sometimes becomes stiff. The heat is disturbing to the body; it stretches out, but it disturbs the person. There is very intense heat, and there is no air conditioning or fan, and the hand fan is broken. This hand fan has nothing to offer; he is exhausted. They say, "You must judge." What does he say to them? He says, "Wait until the end of the day. Wait, I will go, take a shower, refresh myself, and come back, because the heat is disturbing, and it is not permissible to judge while in such a state. All these conditions mentioned by the author are based on the saying of the Messenger (peace and blessings be upon him) Jami` at-Tirmidhi 1334Sahih (Darussalam). Whenever a condition befalls the judge that acts as a barrier between him and understanding the case or applying the rulings of the Shari'ah to it, it is forbidden for him to judge in it until this cause is removed, because the ruling follows its cause in existence and non-existence.
