The Shaykh :"And if he contradicted [the ruling] but hit the truth, it is carried out" If the judge contradicted [the ruling], meaning if the judge contradicted and issued a judgment in these situations where it is not permissible for him to judge, and he hit the truth, his judgment is carried out. If someone were to ask, "How is it carried out when it is forbidden, and the Prophet (peace and blessings be upon him) said Sahih Muslim 1718b? Isn't the principle that such a thing necessitates the invalidity of the judgment, just as if one contracted a marriage with a woman in a forbidden manner, the contract is invalid?" The answer is that the prohibition of that is out of fear of contradicting the correct ruling. So if he hits the correct ruling, that is what is sought. It is clear that here we say this has not departed from the principle, which is that the forbidden thing is not carried out and is not valid, because the cause for which it was forbidden has ceased, since he hit the correct ruling. For this reason, he said, "And if he contradicted [the ruling] but hit the truth, it is carried out". If he did not hit the truth, it is not carried out. It is not carried out because it is not in accordance with the ruling of Allah and His Messenger. This man did wrong by judging in a state of anger or hunger or the like, and he did not hit the truth. So he is not correct, neither in his proceeding to judge nor in his judgment. Thus, the judgment is invalid.
