Question:
A fatwa has circulated from some of the scholars, may Allah have mercy on them, whether living or dead, regarding the permissibility of that breaking of sorcery through sorcery due to necessity. Does not the saying of the Prophet (peace and blessings be upon him), "The limit of the sorcerer is...," suffice? And does it not cut off the matter entirely, prohibiting it absolutely, without mentioning the second opinion of the scholars?

In any case, the second opinion is wrong. His saying, "The limit of the sorcerer is a strike with the sword," is like what was mentioned before: it is mawquf (stopping at a Companion), but it is in the ruling of marfu' (traced to the Prophet). And the text of the Qur'an declares the sorcerer a disbeliever:
But the two angels do not teach anyone unless they say, "We are a trial, so do not disbelieveوَمَا يُعَلِّمَانِ مِنْ أَحَدٍ حَتَّى يَقُولَا إِنَّمَا نَحْنُ فِتْنَةٌ فَلَا تَكْفُرْ
[al-Baqarah:102].
