Question:
You also say in another question: A person gifted his mother a gift of gold, and as time passed, he needed this gift, so he took it from his mother. What is the ruling?

Answer:
If his mother is pleased and gives him the gift, and he has no brothers, or he has brothers who are pleased—adult, sane brothers who are pleased—there is no harm. However, if he has young brothers, or if they are not pleased, he has no right to take it. Rather, it belongs to all of them, because the Messenger of Allah (peace and blessings be upon him) said:
Be afraid of Allah, and be just to your children.اتقوا الله، واعدلوا بين أولادكم
Sahih al-Bukhari 2587
; because she has taken ownership of it, so he has no right to take it alone. Rather, she must distribute the gift between him and his brothers, unless they permit it if they are sane, in which case there is no harm if they permit it. Otherwise, she must hold onto it and not return it to him. Yes.
