What is the ruling if a man suspects one of a group that he is the one who stole his money, so he asks all of them to swear that they did not take his money?

The questioner : He suspects one of them, but he cannot, meaning he says to him, "You are the one," so he asks: Is it permissible for me to ask the five, or more, or fewer, to swear an oath? Is it prescribed for them to swear, meaning that one of them did not take this money?

The Shaykh : There is no precedent in the early era for this, first of all. And secondly, the accused may actually be forced to swear falsely, and therefore we do not recommend this.

The questioner : What do you advise this man to do? For example, he says, "I suspect so-and-so, and so-and-so must..."

The Shaykh : If his suspicion is strong, he should investigate with him privately, and based on what he hears from him, he should strengthen or weaken his suspicion.

The questioner : At that point, he asks him. May Allah reward you with good, our Shaykh, may Allah bless you.

The Shaykh : Welcome, welcome.

The questioner : And peace be upon you, and Allah's mercy and blessings.

The Shaykh : And upon you be peace. Is there any need?
