We return at the beginning of this episode to the message from listener (A. A. G.) from Hadramaut. We presented some of his questions in a previous episode, and he has one question remaining in this episode. He says: I have been informed that the Messenger of Allah (peace and blessings be upon him) said:
The punishment of the Sahir is a strike of the sword.حد الساحر ضربه بالسيف

. Is this hadith authentic? Please inform us, may you be rewarded, if Allah wills?

Answer: In the name of Allah, the Most Merciful, the Bestower of Mercy. Praise be to Allah, and may Allah send prayers and peace upon the Messenger of Allah, and upon his family and his Companions, and upon whoever follows his guidance.
As for what follows: This hadith is narrated from the Prophet (peace and blessings be upon him), but it is weak in its chain of narration according to the scholars. The authentic position is that it is mawquf (stopping at a Companion) with Jundub ibn Abdullah al-Bajali. It was also said that its narrator is Jundub al-Khayr al-Azdi. He is the one who said:
The punishment of the Sahir is a strike of the sword.حد الساحر ضربه بالسيف

. However, such a statement has the ruling of being marfu' (traced to the Prophet); because it is not said based on personal opinion. If not for the fact that the Companion knew, he would not have been certain of this great statement.
This indicates that the sorcerer must be killed and is not offered the chance to repent; because his corruption is great, and because he usually hides behind his sorcery, claiming to repent but not being truthful in it; because his sorcery is hidden from many people; and because his harm is great, so he must be killed to protect the society from his corruption and harm. And if he is truthful in his repentance, his matter is left to Allah, and Allah may accept his repentance.
It is established from 'Umar (may Allah be pleased with him) , the Commander of the Faithful, that he wrote to the army in Sham to kill every male and female sorcerer, and he did not order them to offer the chance to repent; he did not order the commanders to offer the chance to repent. This indicates that the sorcerer is killed without being offered the chance to repent, as the Rightly Guided Caliph 'Umar ibn al-Khattab (may Allah be pleased with him) ruled. This supports what Jundub narrated, both as marfu' and mawquf. Likewise, it is established from Hafsa, the Mother of the Believers, daughter of 'Umar (may Allah be pleased with them both), that she killed a slave girl who had bewitched her, and she did not offer her the chance to repent.
Imam Ahmad (may Allah have mercy on him) said: The killing of the sorcerer without offering the chance to repent is established from three of the Companions of the Prophet (peace and blessings be upon him), namely: 'Umar ibn al-Khattab, his daughter Hafsa, and Jundub al-Khayr al-Azdi.
In summary: This is the correct position, that if the sorcery of a sorcerer is established, and likewise for a female sorcerer, each of them is killed without being offered the chance to repent, in order to cut off the source of his danger and harm, and in accordance with the ruling of the aforementioned Companions (may Allah be pleased with them) .
The dangers of the sorcerer are great. He may engage in what causes the death of a person, he may engage in what separates a person from his wife, and he may engage in things that cause clear harm to a person. His harms are many and his evils are great. He is a disbeliever, as Allah (Mighty and Majestic) said regarding the two angels:
But the two angels do not teach anyone unless they say, "We are a trial, so do not disbelieveوَمَا يُعَلِّمَانِ مِنْ أَحَدٍ حَتَّى يَقُولا إِنَّمَا نَحْنُ فِتْنَةٌ فَلا تَكْفُرْ
[al-Baqarah: 102]. This indicates that the sorcerer becomes a disbeliever as soon as he learns sorcery or practices it; he becomes a disbeliever.
And Allah (Mighty and Majestic) is the One who grants success. Yes.
