We returned from the mountain after Maghrib to Muzdalifah and arrived in the middle of the night. We prayed Maghrib and 'Isha, and then we went to Mina and arrived before Fajr. We were unable to spend the night in Muzdalifah. What is your opinion regarding not spending the night in Mina on the eighth? And what is your opinion regarding not spending the night in Muzdalifah after descending from 'Arafat? May Allah reward you with good. The answer: As long as the situation is as the questioner described, he owes nothing. This is because his passing through Muzdalifah after the middle of the night and combining the prayers there, all of this suffices, and praise be to Allah. And because he is excused due to the groups and his inability to stay, there is no blame on him in that. Spending the night in Muzdalifah is obligatory according to the correct view. Some scholars said: It is a pillar. The correct view is that it is obligatory. Others among the scholars said: It is a recommended practice. The correct view is the middle position: it is not a pillar, but it is above a recommended practice; it is obligatory. Because the Messenger (peace and blessings be upon him) spent the night there and said:
Take your rituals from meخذوا عني مناسككم
, O Allah, send blessings and peace upon him...
So it is obligatory for pilgrims to spend the night in Muzdalifah until after the middle of the night. And whoever arrives there after the middle of the night, that suffices for him, if he leaves it at the end of the night. It is permissible for the weak among women and their followers to leave after the middle of the night to Mina before the crowd descends. Because the Messenger (peace be upon him) granted them a dispensation in that, peace and blessings be upon him. The summary is that whoever spends the night there has fulfilled the obligation. And whoever leaves it after the middle of the night, there is no blame on him. And there is no blame on the weak to leave in the last part of the middle of the night before the crowd descends, because the Messenger granted them a dispensation, peace and blessings be upon him. And if one is prevented from doing so due to a legal excuse, such as his car breaking down and he did not reach Muzdalifah, there is no blame on him, if Allah wills. Because he is excused by a legal excuse. And likewise, if one is prevented from staying there because the organizers of his group prevented him from staying in Muzdalifah and prevented him from doing so, we hope that there is no blame on him, if Allah wills. And if he pays a ransom as a precaution with a sacrificial animal slaughtered in Mecca for the poor, as a precaution, then that is good, if Allah wills.
As for the night of the ninth in Mina, it is not obligatory. Spending the night in Mina on the night of the ninth is not... obligatory. It is not obligatory, but it is recommended. The Messenger (peace and blessings be upon him) spent the night there on the night of the ninth. So if he spends the night in Mina on the night of the ninth, that is better. Otherwise, it is not obligatory. If he did not come to Mina until the ninth day and traveled from there to 'Arafat, there is no blame in that. Yes.
