Q3: Some Hajj companies take the pilgrims in buses from Makkah directly to 'Arafah without staying overnight in Mina on the Day of Tarwiyah, then they return them from 'Arafah directly to Mina without staying overnight in Muzdalifah or even remaining there until midnight, and they justify this by the heavy crowds. Is there a sin on the pilgrims for this, or what should they do?
A3 : Staying overnight in Mina on the night of the ninth is a recommended practice (sunnah); if one leaves it off, he owes nothing. As for staying overnight in Muzdalifah on the night of the tenth, it is an obligatory duty of Hajj; if one leaves it off while being able to do it, he owes a fidyah of slaughtering a sheep in the Haram and distributing it to the poor of the Haram. And as for those who are unable to stay overnight, such as the sick and the weak whose condition compels them to leave it off, they owe nothing.
