Question:
The listener, Imran Musa, from the Arab Republic of Egypt, sent a question saying: What is the interpretation of the saying of the Truth—Blessed and Exalted is He: I seek refuge in Allah from the accursed Shaytan:
And whoever does not judge by what Allah has revealed - then it is those who are the disbelievers.وَمَنْ لَمْ يَحْكُمْ بِمَا أَنزَلَ اللَّهُ فَأُوْلَئِكَ هُمُ الْكَافِرُونَ
[Al-Ma'idah: 44]?

Answer:
It is known among the scholars, as Ibn Abbas said, that
A disbelief less than disbeliefكفر دون كفر
, if a person believes that the ruling of Allah is obligatory, and that judging by other than what Allah has revealed is not permissible, but he judges by other than what Allah has revealed for other reasons, then in that case he is an open sinner, a wrongdoer, and a disbeliever, but it is a wrong less than wrong, an open sinfulness less than open sinfulness, and a disbelief less than disbelief; because he knows that he is a wrongdoer, that he is mistaken, and that he is disobedient to Allah, but what led him to judge by other than what Allah has revealed were reasons he believed justified his bad action, such as taking a bribe, or his position in authority and dominion, and the like. This is a disbelief less than disbelief, a wrong less than wrong, and an open sinfulness less than open sinfulness.
As for the one who judges by other than what Allah has revealed while believing that it is permissible, or that it is better than the ruling of Allah; this is a disbeliever with major shirk. Some people—we seek refuge in Allah—believe that the time for judging by what Allah has revealed has passed, and that it is not fitting for the people of this age. This is among the greatest of disbelief. We ask Allah for safety.
Likewise, if he believes that it is permissible, or that it is inferior, but permissible, whereas the ruling of Allah is better, all of this is disbelief. One must believe that the ruling of Allah is obligatory and binding, and that judging by other than what Allah has revealed is a matter that must be discarded and abandoned, and that it is what is wrong.
So, if he finds it agreeable and deems it permissible, even if he sees that the Shari'ah is better than it; then he is a disbeliever. We ask Allah for safety.
