The eleventh question of Fatwa No. ( 5741 ):
Q11: Is one who does not judge by what Allah has revealed a Muslim or a disbeliever who commits major shirk (associating partners with Allah), and are his deeds accepted?
A11: Allah the Exalted said:[Al-Ma'idah 5:44] And Allah the Exalted said: [Al-Ma'idah 5:44] And Allah the Exalted said: [Al-Ma'idah 5:44] , but if he considers that permissible and believes it to be lawful, it is major shirk (associating partners with Allah), major injustice, and major open sinfulness that takes him out of the religion. However, if he does it for a bribe or another purpose while believing that it is forbidden, he is sinful; he is considered a disbeliever who commits minor shirk (associating partners with Allah), an unjust person who commits minor injustice, and an open sinner who commits minor open sinfulness that does not take him out of the religion, as the scholars clarified in their interpretation of the aforementioned verses. And success is from Allah. May Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.

And whoever does not judge by what Allah has revealed - then it is those who are the disbelievers.
وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْـزَلَ اللَّهُ فَأُولَئِكَ هُمُ الْكَافِرُونَAnd whoever does not judge by what Allah has revealed - then it is those who are the disbelievers.
وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْـزَلَ اللَّهُ فَأُولَئِكَ هُمُ الظَّالِمُونَAnd whoever does not judge by what Allah has revealed - then it is those who are the disbelievers.
وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْـزَلَ اللَّهُ فَأُولَئِكَ هُمُ الْفَاسِقُونَ
