A sister in Allah: (L. R. 'A) from Riyadh also asks and says: What is the ruling on one who commits an invalidator of fasting while ignorant of the ruling? Does he have to make up his fast?
Answer: Yes, he has to make up the fast, just as one who eats thinking there is no harm in eating during the day of the obligatory fast, or one who has intercourse, must make it up; because he is negligent through laxity and lack of understanding of the religion. This is unlike the one who forgets, for whom there is no obligation. If he eats or drinks while forgetting, there is no obligation on him, as he (peace and blessings be upon him) said:
If anyone forgets that he is fasting and eats or drinks he should complete his fast, for it is only Allah Who has fed him and given him drink.من نسي وهو صائم فأكل أو شرب فليتم صومه، فإنما أطعمه الله وسقاه
Sahih Muslim 1155
, and in the other wording:
Whoever breaks his fast during Ramadan due to forgetfulness is not to make up for the day later or perform an expiation.من أفطر في رمضان ناسياً فلا قضاء عليه ولا كفارة
Bulugh al-Maram 5:21
. So if his consuming the invalidator was due to forgetfulness, then his fast is valid. But if he eats, drinks, or has intercourse claiming that he is ignorant of the ruling, he is ordered to make it up; because in this case he is considered negligent and lax, and it was obligatory for him to ask. And because these matters are well-known among Muslims and recognized by Muslims, the claim of ignorance is far-fetched; the claim of ignorance in this matter is very far-fetched. Yes.
