Question:
Our brother asks another question and says: There is a deduction taken from the employee's salary by the state to save it for him, and when he retires or resigns, they return it to him with an increase. Is there zakah on the deducted amount?

Answer:
No, there is no zakah on it because it is not in his possession, and he does not know what Allah will decree regarding it. So when it reaches him later, or reaches his heirs, they should pay zakah on it if a lunar year has passed over it. Whatever has a lunar year passing over it, they should pay zakah on it if it remains with them. If they consume it before the lunar year passes, then there is nothing on them. And so it is if he receives the retirement pension during his lifetime; if a lunar year passes over it and it is the nisab, he pays zakah on it, and if not, he does not. Yes.

The presenter : May Allah reward you with good. He spends it on a monthly value, approximately, for the retiree, O Shaykh?

The Shaykh : He should take it after he retires. If the money remains with him until a lunar year passes over it, he pays zakah on it.

The presenter : The amount he receives?

The Shaykh : After he has received it, yes, every month.

The presenter : Every month?

The Shaykh : Yes. And if he consumes it before the completion of the lunar year, or pays a debt with it, or the like of that, then there is nothing on him. Yes.

The presenter : So its ruling is approximately the ruling of the salary?

The Shaykh : The ruling of the salary in other than retirement, yes, it is the same, the same. Yes.

The presenter : May Allah reward you with good.
