The ruling on one who performs Hajj while abandoning the prayer

Machine translationRead the Arabic original
Question:
What is the ruling on one who performs Hajj while abandoning the prayer, and does it suffice for the Hajj of Islam?

Answer:
Abandoning the prayer is major disbelief. One who does it intentionally is a disbeliever with major disbelief. The scholars differed on whether his Hajj suffices and whether this is a lesser form of disbelief. The correct view is that this is major disbelief, and that the Hajj of one who does not pray does not suffice for him. Rather, he must repeat it if he repents. And whoever repents, Allah accepts his repentance. This is the correct view, based on the saying of the Prophet (peace and blessings be upon him):
The covenant that distinguishes between us and them is prayer; so whoever leaves it, he has committed Kufr.العهد الذي بيننا وبينهم الصلاة فمن تركها فقد كفر
Sunan Ibn Majah 1079Sahih (Darussalam)
, and he (peace and blessings be upon him) said:
Between a man and disbelief and shirk (associating partners with Allah) is the abandonment of prayer.بين الرجل وبين الكفر والشرك ترك الصلاة
, narrated by Muslim in the Sahih.
Therefore, it is obligatory for the believer to be cautious of that. If he is in a state of not praying when he performs the Hajj, he must repeat the Hajj when he returns to Allah. And whoever repents, Allah accepts his repentance.
