Question:
The listener, Hizaz Abdullah al-Sharif, sent a question saying: My father’s mother passed away two years ago. She was neglecting prayer, but she used to fast in Ramadan. My father performed Hajj on her behalf last year. Is this Hajj valid?
Answer:
One who neglects prayer is a disbeliever according to a group of scholars, even if he is not known to deny its obligation; because neglecting prayer is among the major sins. The Prophet (peace and blessings be upon him) clarified that one who neglects it becomes a disbeliever. He said, (peace and blessings be upon him): The ruling applies to both men and women. Rulings attached to men apply to women, and those attached to women apply to men, except where evidence specifies otherwise. Therefore, in another hadith, he (peace and blessings be upon him) said: Sunan Ibn Majah 1079Sahih (Darussalam) This applies to both men and women.
........ He should not perform Hajj on his behalf, nor 'Umrah on his behalf. However, a group of scholars held that one who neglects it not out of denial of its obligation, but out of laziness, is not declared a disbeliever for that, but has committed a great sin and a great evil. However, he does not become a disbeliever by major shirk, but his disbelief is minor shirk. According to this view, Hajj on his behalf is valid according to a group of scholars who said that a Muslim is not declared a disbeliever for neglecting prayer unless he denies its obligation.
As for one who neglects it out of laziness while knowing that it is obligatory and that it is a fard, but his laziness and laxity lead him to neglect it; this, according to a group of scholars, does not make him a disbeliever by major shirk, but his disbelief is minor shirk.
The correct and most apparent view in the evidence is that he becomes a disbeliever by major shirk—seeking refuge in Allah—because prayer is the pillar of Islam. Whoever preserves it preserves his religion, and whoever neglects it has neglected his religion. We ask Allah for safety.
And by this, it is known that one who neglects prayer should not have Hajj performed on his behalf, nor should supplication be made for him—seeking refuge in Allah—Yes.

Between a man and disbelief and shirk (associating partners with Allah) is the abandonment of prayer.
بين الرجل، وبين الكفر والشرك ترك الصلاةThe covenant that distinguishes between us and them is prayer; so whoever leaves it, he has committed Kufr.
العهد الذي بيننا وبينهم الصلاة، فمن تركها؛ فقد كفر........ He should not perform Hajj on his behalf, nor 'Umrah on his behalf.
