Question:
As for the people of Makkah, are they permitted to shorten the prayer in Mina, or not? And if they go to their homes during the day, do they shorten the prayer?

Answer:
The pilgrims shorten the prayer along with the Muslims. The Messenger of Allah (peace and blessings be upon him) did not order them to complete the prayer when he performed the Farewell Pilgrimage; he did not say, "O people of Makkah, complete the prayer." So if they pray with the people two rak'ahs, there is no blame on them, and if they complete it, there is no blame on them. And if they return to Makkah, they pray in the mosques of Makkah by completing the prayer. They do not pray in their homes; they pray with the congregation by completing the prayer. And if they pray in Mina with the people, they pray two rak'ahs as long as they are pilgrims, and if they pray four, there is no blame on them. This is because some scholars hold that the people of Makkah complete the prayer absolutely, so shortening is not permissible for them, because the sacred sites are not considered travel.
