Question:
Is it permissible for one who comes to Mina and 'Arafah without being in the state of ihram to pray as the pilgrim prays?

Answer:
If he is a pilgrim, yes. If he is not a pilgrim and is from the people of Makkah, he prays four rak'ahs and does not shorten. As for if he is a pilgrim, the Messenger of Allah (peace and blessings be upon him) performed Hajj and led the people in prayer, and he did not order the people of Makkah to complete the prayer. Some scholars said: because of the rites, because of Hajj. And some said: because the distance between Makkah and 'Arafah is far, and it is called travel. In any case, if they shorten the prayer with the people, and they are pilgrims and residents of Makkah, there is no blame on them. And if they complete the prayer to avoid the difference of opinion, there is nothing wrong with that. It is all good, if Allah wills. As for one who is not a pilgrim, he does not pray shortened, but he completes it if he is from the people of Makkah; because it is not the cause of travel nor the cause of Hajj.
