This is a message received from the listener Mahmoud al-Rushdah from Abha. He asks about stoning the pillars on the Day of Sacrifice and the first day of the days of Tashreeq. He says: To the honorable supervisors of the program "Light on the Path"! Peace be upon you and Allah's mercy and blessings. I request your kindness in presenting my question to His Eminence Shaykh Abdul Aziz so that he may graciously study my matter and give me the appropriate solution. The matter is that I performed the obligatory Hajj this past year with colleagues who had performed Hajj more than once. What happened is that we stoned the pillars in only two days, meaning we did not remain in Makkah after the first day of the festival except for one day. On the second day, after the afternoon, we left Makkah on the basis that we hastened in two days, considering the two days to be the first day, which is the Day of Sacrifice, and the second day of the festival. I request your kindness in issuing a ruling for us on this matter. Thank you, and what is obligatory for me to do, even though I am far from Makkah? Thank you.
Answer: The one who left Makkah in his Hajj last year or otherwise, and did not stone the pillars except on the Day of Sacrifice and the day following it, owes a blood sacrifice, a slaughtered animal like the 'Id sacrifice. That is, he must slaughter either a sheep, a one-year-old goat, or one-seventh of a camel, or one-seventh of a cow in Makkah, to be slaughtered in Makkah and distributed among the poor—the poor of Makkah. This is what is required of him, because it is obligatory to stone on the Day of Sacrifice and the two days following it. The days in which hastening is permitted are the three days of Tashreeq, about which Allah the Exalted said:
Then whoever hastens [his departure] in two days - there is no sin upon him; and whoever delays [until the third] - there is no sin upon himفَمَنْ تَعَجَّلَ فِي يَوْمَيْنِ فَلا إِثْمَ عَلَيْهِ وَمَنْ تَأَخَّرَ فَلا إِثْمَ عَلَيْهِ
[al-Baqarah: 203]. These are the days of Tashreeq; the first is the eleventh, and the last is the thirteenth. The Day of Sacrifice is not among them. Therefore, it is obligatory for pilgrims to stone the Jamrat al-Aqabah on the Day of Sacrifice, and the best time is during the late morning. Whoever stones it at the end of the night of the Day of Sacrifice, or at midday on the Day of Sacrifice, or in the afternoon, all of these are valid. Stoning is permitted in the latter half of the Day of Sacrifice, especially for the weak. The entire Day of Sacrifice is for stoning. As for the eleventh, twelfth, and thirteenth days, the pillars are stoned in them after the sun passes its zenith, meaning after the time of the midday prayer begins when the sun has passed its zenith. It is not permissible to stone them before the sun passes its zenith, before the midday prayer. Stoning is only after the sun passes its zenith, as the Prophet (peace and blessings be upon him) stoned them. If one wishes to hasten on the twelfth day after stoning, he stones after the sun passes its zenith, then hastens and goes to Makkah to perform the Farewell Tawaf. There is no harm in this. The Day of Sacrifice is not among the days of Tashreeq; rather, the first is the eleventh and the last is the thirteenth. If one stones on the eleventh and twelfth, there is no harm in hastening to go to Makkah and perform the Farewell Tawaf, or the Tawaf of Hajj if he has not yet performed the Tawaf of Hajj, and it suffices for him as the Farewell Tawaf. If he performs the Tawaf of Hajj after stoning the pillars and leaves for his country, traveling immediately, it suffices for him as the Farewell Tawaf. If he performs the Tawaf of Hajj on the Day of Sacrifice or after it, and then performs the Farewell Tawaf when he leaves, that is more complete and better. The one who left on the twelfth day or at the end of the eleventh day and did not stone except on the Day of Sacrifice and the day following it only, thinking that the Day of Sacrifice is one of the three days, has made a mistake. He owes a blood sacrifice as mentioned earlier, because he left part of the obligation, which is stoning on the twelfth day. Yes.

The Shaykh: No, this is leaving off obligations, and it is not included in that according to the scholars. Leaving off obligations is not covered by this; that applies to prohibited matters. As for this, it is not included. And if he did not spend the night of the twelfth in Mina while he was able to, he also owes a blood sacrifice or charity for this. If he did not spend the night of the twelfth in Mina but spent it in Makkah while he was able to, and he has a residence in Mina where he could stay, then he should give charity or pay a ransom for that, because spending the night in Mina is obligatory with the ability to do so.
