Question:
The listener (A. A. L.) says: I have a friend who bought a house for himself, and it cost him a sum of money that reached three hundred thousand, or more, but he was unable to pay the amount in full, so he remained in debt for approximately fifty thousand. Is he entitled to take from the zakah that comes from the Muslims, given that he owns land and his old house?

Answer:
If he bought the new house for trade, or for the sake of worldly accumulation, and he has a house that suffices him, then he is not entitled to zakah. Rather, he should sell his new house and pay off the debt he owes, or seek that from other sources; because he is not poor as long as he has shelter. He should sell this house, pay off what he owes, and use the remainder for his needs. He is not called poor, and he has land, and he has this new house, and he has shelter.
The owner of zakah must be poor, having nothing that meets his needs and makes him independent of zakah. As for if he has something that makes him independent, such as earnings that meet his need, or a job that meets his need, or wealth from which he can sell to meet his need, then he is not given. Yes.
