Question:
From the Hashemite Kingdom of Jordan, this question was sent by one of the brothers from there, saying: Explain to us the hadith of the Messenger of Allah (peace and blessings be upon him):
The lawful thing which Allah hates most is divorce.إن أبغض الحلال عند الله الطلاق

Answer:
The scholars differed regarding whether this hadith is connected or disconnected. Some of them weakened it because it is disconnected, but the correct view is that there is no harm in it and that it is connected. Its meaning is that divorce should be avoided except out of necessity. It is lawful, not forbidden, but it is the most disliked of lawful things because of the separation it causes between a man and his family.
Therefore, the believer should not resort to divorce if he finds a way to avoid it. If it is possible, and both he and the wife find it beneficial to remain together in a good state, then it is prescribed for him to avoid divorce. If the need arises for divorce due to her bad conduct, or her open sinfulness, or other reasons, such as him not loving her as Allah placed affection in his heart for her, then there is no harm in that.
The point is that divorce is lawful when there is a need for it, but it is the most disliked of lawful things to Allah. The meaning of this is to encourage not divorcing and to urge remaining with the wife if possible, because of the good and chastity in remaining with the wife, and because it is a cause for children, and for his chastity and hers, and lowering the gaze, and other such benefits.
But if affection is not present, or if there are other reasons such as her bad character, or her open sinfulness, or other reasons where the jurist sees benefit in divorcing her, then there is no blame in that.
