Ruling on accepting gifts from one whose wealth is mixed with forbidden wealth
Machine translationRead the Arabic original
Question:
The questioner from Yemen says: I have a neighbor who is committed to the law of Allah, and praise be to Allah, but her husband is a drinker of intoxicants, and there is a doubt regarding his sale of intoxicants. What is the ruling on the food that this neighbor gives me as a gift? Do I eat it or not? And do I accept the gifts she gives me? Knowing that she calls him to Allah, but he does not respond. Please guide us in this matter?
Answer:
There is no blame in that if he permits her to give it to you from his wealth; there is nothing wrong with it; because mixed wealth is permissible to take. The Prophet (peace and blessings be upon him) ate from the food of the People of the Book and bought from them, and they were eating usury or interest, and yet he bought food from them and ate from their food. This indicates that mixed wealth containing usury or interest, or the price of intoxicants, or something similar, where they have other lawful wealth, is permissible. The original ruling is lawfulness and permissibility until you know that this wealth is usury or interest, or that this wealth is from the price of intoxicants. If you know that this food was bought with the price of intoxicants, or bought with usury or interest, it is not permissible. But if you do not know, the original ruling is permissibility and lawfulness.
However, she should stay away from this husband as much as possible. Even if he is a Muslim, his habit of drinking intoxicants is a great sin and open sinfulness. It is better for her and more appropriate for her to seek divorce from him and dislike him, and it is also better for her children. We ask Allah for well-being and safety.
