Answer:
If he repents, Allah will accept his repentance. The wealth is a matter of consideration. Some scholars hold that it belongs to him, based on the saying of Allah the Exalted: [Surat al-Baqarah: 275].
If he takes from it what satisfies his needs and gives charity from it, that is sufficient, if Allah wills. If he purifies himself from all of it and gives it in charity to causes of righteousness, and renews his earnings with lawful means, that is safer and better. However, if he is poor and benefits from it, that is because Allah said:[Al-Baqarah 2:275] This includes the disbelievers who embraced Islam and had been practicing riba, which is forbidden, and it was left with them. The Messenger of Allah (peace and blessings be upon him) did not tell them to return the riba money after they repented and embraced Islam. So, some scholars said that this Muslim is like the disbeliever; whoever is in a worse state than the disbeliever is more deserving of leniency than the disbeliever if he repents, because depriving him of his wealth might also deter him from repenting. If it becomes easy for him to dispose of it, because Islam prevents him from it, and he gives it in charity, that is safer to avoid the disagreement among scholars.
