Question:
From Yemen, he says regarding this question: Your Eminence! Please rule on a man who passed away while his wife was pregnant, and the fetus remained in her womb for three years. The question is: When does this waiting period end for this woman?

Answer:
She remains in the waiting period as long as the fetus is in the womb. As long as it is known that her fetus is in her womb, she remains in the waiting period, even if it stays for three years or four years. As long as it is present and it is known that she has a fetus, she must wait; because of the saying of Allah, the Exalted:
And for those who are pregnant, their term is until they give birthوَأُوْلاتُ الأَحْمَالِ أَجَلُهُنَّ أَنْ يَضَعْنَ حَمْلَهُنَّ
[Al-Talaq: 4]. He did not specify . The fetus may be delayed for reasons, and it may remain in the womb for a year, two years, or more, for reasons necessitated by the wisdom of Allah (Exalted and Majestic is He). So she must be patient until she gives birth.
