Question:
One of the listening sisters, whose name is Halimah, says: I am the mother of a large number of sons, and I am, praise be to Allah, at a level of faith that is not bad. However, my husband knows nothing about it. Since our marriage, which was twenty-five years ago, he has been abandoning the prayer. She describes him with other attributes that the program refrains from mentioning, and she asks for your guidance, O Shaykh.

Answer:
This is a husband in whom there is no good, and it is not permissible to remain with him. Rather, you must separate from him, and you must refrain from him, and he must not approach you, neither through intercourse nor otherwise. This action you have done with him is reprehensible. You have been patient with him for twenty-five years, and he does not pray. This is reprehensible, may Allah protect us from it.
You must repent to Allah for that, and feel remorse for this bad action. This is the correct opinion among the scholars, due to the saying of the Prophet (peace and blessings be upon him):
Between a man and disbelief and shirk (associating partners with Allah) is the abandonment of prayer.بين الرجل، وبين الكفر والشرك ترك الصلاة
narrated by Muslim in his Sahih, and due to his saying (peace and blessings be upon him):
The covenant that distinguishes between us and them is prayer; so whoever leaves it, he has committed Kufr.العهد الذي بيننا وبينهم الصلاة، فمن تركها؛ فقد كفر

And if he has other bad deeds and other sins, it becomes worse upon worse. We ask Allah for safety.
So it is obligatory for you to stay away from him, leave him, and not allow him access to yourself, and refrain from him. If he divorces you and gives you a document to that effect, then praise be to Allah. Otherwise, take the matter to the Shari'ah judge if you are in an Islamic country. Yes.

The Shaykh : This is not an excuse. Your children are yours, and you have more right to your children than this disbeliever. Allah provides for you and for them, Glorified and Exalted is He, and provision is upon Him (Exalted and Majestic is He). And it is upon the Shari'ah judge to compel him to provide what is required in terms of financial maintenance. This is for the Shari'ah judge to handle, and you have more right to your children.
So the result is: this does not prevent staying away from him, and being cautious of him, and not allowing him access to yourself. The children’s provision is upon Allah, and the Shari'ah judge will look into the matter. Yes.
