The Ruling on a Woman Remaining with a Husband Who Does Not Pray

Question:
We now move on to a question that reached the program from Jordan from one of the listening brothers there. He asks about a woman who prays, fasts, and is obedient, but she is with a man who does not pray. How should such a woman act? May Allah reward you with good.

Answer:
If the husband does not pray, it is obligatory for her to leave him and go to her family. This is because abandoning the prayer is a great crime and a great evil. In fact, it is major shirk (associating partners with Allah) according to the most correct of the scholars' opinions, even if he does not deny the obligation of the prayer. As for if he denies its obligation, he is a disbeliever by the consensus of the Muslims, with no dispute among the scholars.
The dispute is only regarding the case where he abandons it while acknowledging that it is obligatory upon him, but his laziness and preoccupation with worldly affairs lead him to do so. This is the point of disagreement.
The correct view is that he becomes a disbeliever by doing so. This is based on the saying of the Prophet (peace and blessings be upon him) in the authentic hadith:
Between a man and disbelief and shirk (associating partners with Allah) is the abandonment of prayer.بين الرجل وبين الكفر والشرك ترك الصلاة
It was narrated by Imam Muslim in his Sahih, may Allah have mercy on him, from Jabir ibn 'Abd Allah al-Ansari. Ahmad, may Allah have mercy on him, and the people of the Sunan also narrated it with a sound chain from Buraydah (may Allah be pleased with him) from the Prophet (peace and blessings be upon him) that he said:
The covenant that distinguishes between us and them is prayer; so whoever leaves it, he has committed Kufr.العهد الذي بيننا وبينهم الصلاة، فمن تركها فقد كفر

There are other hadiths that indicate this meaning.
It is obligatory for every Muslim to fear Allah, to preserve the prayer at its time, to perform it in congregation as Allah has prescribed, and to beware of being negligent with it.
When a person abandons it, it is forbidden for the wife to remain with him while she is a Muslim woman who prays. She does not remain with him. This is the correct view and the stronger of the two opinions. When he repents, Allah accepts his repentance. When he repents and his repentance is established, reconciliation between him and his wife becomes possible.
Likewise, anyone who engages in an act of disbelief that takes him out of Islam is separated from his Muslim wife until he returns to Islam and repents. After this, the matter of his returning to her is considered. We ask Allah for guidance for everyone.
